The case of  Kalipi v. Hawaiian Trust  deals with the rights of William Kalipi, a Native Hawaiian, to enter undeveloped lands necessary for Native Hawaiian Practices, such as Kahana Ahupuaa tenants in referring to the the Hawai'i State Constitution, Article XII, Section 7, the decision reads:  "For the court's obligation to preserve and enforce such traditional rights is a part of the State Constitution." The Kalipi Case has lay out certain conditions, tenants of an ahupuaa, are interpreted as saying :  "...that lawful occupants of an ahupua'a may, for the purpose of practicing Native Hawaiian customs and traditions, enter undeveloped lands within the ahupua'a to gather those items so enumerated in the statute (p.7-8)."

"Lawful occupants" are further defined as:

"...persons residing within the ahupua'a in which they seek to exercise gathering rights...It (HRS 7-1) requires that the tenants be 'on' the land before they become entitled to take products from the land on which they live'.

The Court further requires that:  "...these rights be exercised on undeveloped lands (p.8)

I my self also went to court for tresspassing and living on Keaukaha Tract 2  "Ahupua'a". Plaintiffs are State of Hawaii, Department of Hawaiian Home Lands c/o Linda Chinn DHHL Land Management Division, Herman Costa President of Malama ka aina Hana ka aina Inc. a non-profit organization using HCCA of 1920, plaintiffs file an Ejectment for tresspassing on ceded land, deputy attorney filed motion to dismiss on May 29,2008 "The following are facts why motion should be granted, Plaintiff is unable to meet its burden of proof under the Verified Complaint as filed with the Court on March 12, 2008. Motion granted 2008 JUN 17 AM 8:21 District Court of the Third Circuit.
